Gradefix, LLC reserves the right to update and change the Terms of Use from time to time without notice. You are responsible to stay current of changes to the Terms of Use by periodically checking back to this page. Continued use of the service after any such changes shall constitute your consent to such changes.

Communication

When you send e-mails to Gradefix, you are communicating with Gradefix, and by doing so consenting to receive communications from Gradefix electronically.

Intellectual Property

You will respect all items and concepts as found on Gradefix.com with its respective pages as property of Gradefix, LLC. Items include: Text, graphics, logos, button icons, images, video clips, digital downloads, data compilations, and software, but not limited to. Concepts include schedule generation and the algorithms used by Gradefix LLC, but are not limited to.

You agree not reproduce, adapt, imitate, sell, resell or exploit the services provided by Gradefix, LLC without written consent of Gradefix, LLC.

Legal Provisions

If you are using Gradefix.com illegally, Gradefix, LLC holds the right to terminate your account. You agree to accept responsibility for all activities that occur under your account

If Gradefix, LLC fails to exercise or enforce any right or provision of the Terms of Use that will not constitute a waiver of such right or provision. The Terms of Use constitutes the entire agreement between you and Gradefix, LLC and govern your Terms of Use, superceding any prior agreements between you and Gradefix, LLC (including, but not limited to, any prior versions of the Terms of Use).

You must be of legal age to use Gradefix.com in respect to your local laws. Otherwise, to hold an online account with Gradefix.com you must use Gradefix only by consent of your appropriate guardian

User Agreement

Gradefix, LLC services may only be used by living humans. No robots or other automated use of Gradefix, LLC services is permitted. Each user is only allowed one free account. Sharing accounts is not permitted.

Information Policy

All account page information you provide must be valid and verifiable. Billing account information requires a valid credit card.

If you use Gradefix's services you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer.

Gradefix holds the right to posts ads on free version accounts.

Billing Policy

You will be billed according to the version of which you have selected. You may cancel a paying account, or switch to the Free plan, at any time with no additional charge. Billing for paying accounts will occur monthly on the anniversary date of when you started on the paying plan. Payment is due every month for the next month's service. Billing will reoccur that same day of every proceeding month from the first billing date.

Refund Policy

In order to keep pricing to a minimum, there will be no refunds. Accounting for refunds is not an expense which Gradefix will pass onto the active users. Once an account has been canceled, that account will never be billed again.

The user is responsible for paying all taxes due to their local taxing authority including all levies and duties, excluding only United States (federal or state) taxes.

Downgrading/Cancellation Policy

The User holds the right to cancel their account at anytime and will never be billed again. Downgrading a user account has the potential risk of loss of data for which Gradefix is not to be held liable.

Cancellation is the responsibility of the user and may only be terminated by using the "My Account" page. No emails or other notice cancellations are permitted.

Declination of Payment Policy

If the user cannot pay for their account, Gradefix holds the right to freeze the user's account or terminate use.

Service Policy

Under no circumstances shall Gradefix LLC be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

Gradefix reserves the right to update and modify the service at anytime. At the event that there may be major changes in service, users will receive a 30-day notice of such change.

Support Policy

Support is provided in priority of first to paying users and only available by email. Response time is generally from 1 to 5 hours during mountain standard business hours.

Gradefix cannot guarantee that the service will meet your specific user requirements, be error free, timely, secure, or that errors will be corrected. However, our goal is continuously improve the Gradefix service and its functionality.

Dispute

Any dispute relating in any way to your visit to gradefix.com or to services you use through Gradefix, LLC shall be submitted to confidential arbitration in Salt Lake City, Utah. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association.

What Information does Gradefix Collect?

We collect the Information You Give Us: We receive and store any information you enter on our Web site or give us in any other way. If you choose to provide us with personal information, you consent to the transfer and storage of that information to our servers.

No Spam

We and our users do not tolerate spam. The only emails you will receive from us would be only in regard to your account or new features for the services you use. No solicitations or other unwanted emails will be sent to you.

We do not sell or rent your personal information to third parties. We may combine your information with information we collect from other companies (such as demographic data) to improve and personalize our services.

Account Protection

Your password is the key to your account. Use unique numbers, letters, and special characters and do not disclose your password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify Gradefix and change your password.

We do retain the right to hold personal information from closed accounts in order to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Conditions of Use, and take other actions otherwise permitted by law.

For paying accounts, credit card or other payment account information which we maintain on secure servers.

Your choices

You can terminate your Gradefix Account at any time. You can change or delete the account settings on your "My Account" page.

How we use your information

Gradefix only processes personal information for the following reasons:

1. Providing our products and services to users.
2. Auditing, research and analysis in order to maintain, protect and improve our services.
3. Ensuring the technical functioning of our services.
4. Developing new services.

We will offer new and other products and services under Gradefix, LLC which will help enhance the student experience, your information will be available to use if you choose to use these other products or services for your convenience.

Security

Your information is stored on our servers located in the United States. We treat data as an asset that must be protected and use lots of tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Gradefix may amend this Privacy Policy at any time by posting the amended terms on the Site. All amended terms automatically take effect 30 days after they are initially posted on the Site.
